NEW YORK (MarketWatch) — We’re still feeling the aftershocks from the bombshell complaint the Securities and Exchange Commission filed against Goldman Sachs Group Inc.
Though the case is a long way from being resolved — and appears to have some big legal weaknesses — several things are clear by now. The once untouchable Goldman has suffered a severe blow to its reputation. The SEC has taken a small step to restoring its own once-good name.
This politically polarized case (which got through a divided Commission by one vote) has been a shot in the arm for the Obama administration’s efforts to get financial reform through Congress. And more big Wall Street firms may be in the SEC’s crosshairs for doing similar things to what Goldman is alleged to have done.
But even after the worst financial crisis since the 1930s, the Wall Street banks have won victory after victory in their lobbying efforts and have paid their undeserving minions rich bonuses, which have really stuck in the public’s craw.
I fervently hope that finally, finally something will be done to curb this extraordinary abuse of power by these opaque, unaccountable firms that have done so much damage.
At a time when most Americans are wary, even hostile, to big government–and rightly so–they just as decisively support reining in Wall Street’s dukes and duchesses with sensible regulation that prevents them from screwing things up again for the rest of us.

Is Goldman Sachs Making Too Much Money?
There’s no shame in making money. Making money is, after all, every company’s goal. And when our companies do well, that’s generally good for the country. Under normal circumstances Goldman Sachs would have every reason to brag about it’s first quarter profits.
But now—with Goldman facing charges for securities fraud and apparently seeking to block financial reform legislation—the bank’s windfall profits seem to raise the question of whether it’s making its money legitimately.
Goldman reported an impressive $3.3 billion first quarter profit today. That’s its second highest quarterly profit since going public in 1999, and it comes after earning a record $4.79 billion in the fourth quarter of last year. It’s also an increase of 91% on the year. And on revenue of $12.8 billion it’s a tidy 26 cents profit for every dollar it earned, which is actually down from the from the almost 50 cents of profit it made for every dollar of revenue the quarter before.
Of course, these profits have nothing to do with the 2007 trades the Securities and Exchange Commission says are fraudulent. And Goldman’s reputation as the gold standard of banks is well-earned, so it should be no surprise that it’s doing well.
But you still have to wonder just how it’s making so much money in an otherwise anemic economy.

It’s open season on Obama whom so many hoped would lead us out of the neo-liberal wilderness. He once was a community organizer and ought to know how working people have suffered through a generation of tax breaks for the rich, Wall Street deregulation, and unfair competition.
When the economy crashed he was in the perfect position to limit the unjustified pay levels on Wall Street and bring a crashing halt to the runaway financialization of our economy. Instead we got a multi-trillion dollar bailout for Wall Street, no health care reform, no serious financial reforms whatsoever, record unemployment, and political gridlock that’s will be with us for years to come.
Is it his fault? Or ours?
Obama has made his share of blunders. However, his statement that we “don’t begrudge” the high salaries on Wall Street because that’s part of the “free-market system” is about the dumbest thing he’s ever said. He was referring to Jamie Dimon’s $17.4 million payday, and Lloyd Blankfein’s $9 million.
But surely the President knows that at this very moment Wall Street is still receiving $10.4 trillion (not billion) in subsidies from the taxpayer — and that’s after the TARP repayments. That’s some free-market.
Dimon’s JP Morgan Chase still has a $34.3 billion subsidy, and Blankfein at Goldman Sachs is sitting on $23.9 billion of government welfare. (Many thanks to Nomi Prins for her first rate sleuthing.. ) Dimon and Blankfein would love to re-write history so that they could be portrayed as swashbuckling entrepreneurial survivors, men who avoided the bad risks that felled so many others.
But without government welfare their institutions would have gone under. They are two very lucky (and well connected) welfare recipients — lucky not to be among the 28 million Americans that go without jobs or are forced into part-time work.
We can moan all we want about Obama’s shortcomings, the mistakes his Administration has made and his inability to take on Wall Street. But we haven’t exactly applied a lot of heat. A million people on the mall demanding “Jobs Now” along with serious Wall Street reforms might help. A million people showing up repeatedly might actually get the job done.
The free market on Wall Street is dead and has been for a long time. It’s been replaced by a billionaire bailout society that will provide decades of chronic unemployment and on-going bailouts for the super-rich. It’s a damn shame Obama can’t deal with it. It’s a bigger shame that we won’t force him too.

GMAC Loses $5 Billion in Fourth Quarter
NEW YORK (Reuters) – GMAC Financial Services, a lender that has received more than $16 billion from the U.S. government across multiple bailouts, said it lost $5 billion in the fourth quarter after writing down bad mortgage assets.
GMAC, one of the largest car loan makers in the United States, said in December that it did not expect to record more major losses from its mortgage unit. Home loans fueled GMAC’s growth earlier this decade but have since triggered billions of dollars of losses for the company.
The fourth-quarter loss compares with net income of $7.5 billion in the fourth quarter of 2008.

THERE may not be a person in America without a strong opinion about what coulda, shoulda been done to prevent the underwear bomber from boarding that Christmas flight to Detroit. In the years since 9/11, we’ve all become counterterrorists.
But in the 16 months since that other calamity in downtown New York — the crash precipitated by the 9/15 failure of Lehman Brothers — most of us are still ignorant about what Warren Buffett called the “financial weapons of mass destruction” that wrecked our economy. Fluent as we are in Al Qaeda and body scanners, when it comes to synthetic C.D.O.’s and credit-default swaps, not so much.
What we don’t know will hurt us, and quite possibly on a more devastating scale than any Al Qaeda attack. Americans must be told the full story of how Wall Street gamed and inflated the housing bubble, made out like bandits, and then left millions of households in ruin.
Without that reckoning, there will be no public clamor for serious reform of a financial system that was as cunningly breached as airline security at the Amsterdam airport. And without reform, another massive attack on our economic security is guaranteed.
Now that it can count on government bailouts, Wall Street has more incentive than ever to pump up its risks — secure that it can keep the bonanzas while we get stuck with the losses.

Banks Prepare to Pay Record Bonuses to Employees
The bank bonus season, that annual rite of big money and bigger egos, begins in earnest this week, and it looks as if it will be one of the largest and most controversial blowouts the industry has ever seen.
Bank executives are grappling with a question that exasperates, even infuriates, many recession-weary Americans: Just how big should their paydays be? Despite calls for restraint from Washington and a chafed public, resurgent banks are preparing to pay out bonuses that rival those of the boom years. The haul, in cash and stock, will run into many billions of dollars.
Industry executives acknowledge that the numbers being tossed around — six-, seven- and even eight-figure sums for some chief executives and top producers — will probably stun the many Americans still hurting from the financial collapse and ensuing Great Recession.
Goldman Sachs is expected to pay its employees an average of about $595,000 apiece for 2009, one of the most profitable years in its 141-year history. Workers in the investment bank of JPMorgan Chase stand to collect about $463,000 on average.
Even some industry veterans warn that such paydays could further tarnish the financial industry’s sullied reputation. John S. Reed, a founder of Citigroup, said Wall Street would not fully regain the public’s trust until banks scaled back bonuses for good — something that, to many, seems a distant prospect.
“There is nothing I’ve seen that gives me the slightest feeling that these people have learned anything from the crisis,” Mr. Reed said. “They just don’t get it. They are off in a different world.”
That 1937 Feeling
Here’s what’s coming in economic news: The next employment report could show the economy adding jobs for the first time in two years. The next G.D.P. report is likely to show solid growth in late 2009. There will be lots of bullish commentary — and the calls we’re already hearing for an end to stimulus, for reversing the steps the government and the Federal Reserve took to prop up the economy, will grow even louder.
But if those calls are heeded, we’ll be repeating the great mistake of 1937, when the Fed and the Roosevelt administration decided that the Great Depression was over, that it was time for the economy to throw away its crutches. Spending was cut back, monetary policy was tightened — and the economy promptly plunged back into the depths.
This shouldn’t be happening. Both Ben Bernanke, the Fed chairman, and Christina Romer, who heads President Obama’s Council of Economic Advisers, are scholars of the Great Depression. Ms. Romer has warned explicitly against re-enacting the events of 1937. But those who remember the past sometimes repeat it anyway.
During the good years of the last decade, such as they were, growth was driven by a housing boom and a consumer spending surge. Neither is coming back. There can’t be a new housing boom while the nation is still strewn with vacant houses and apartments left behind by the previous boom, and consumers — who are $11 trillion poorer than they were before the housing bust — are in no position to return to the buy-now-save-never habits of yore.
What’s left? A boom in business investment would be really helpful right now. But it’s hard to see where such a boom would come from: industry is awash in excess capacity, and commercial rents are plunging in the face of a huge oversupply of office space.
Will the Fed realize, before it’s too late, that the job of fighting the slump isn’t finished? Will Congress do the same? If they don’t, 2010 will be a year that began in false economic hope and ended in grief.
